Three New York City area restaurants are required to pay $1,085,752 in back wages, interest, and liquidated damages to over two hundred employees, as a result of two consent judgments recently entered in federal courts in the Southern and Eastern Districts of New York
Asian Moon Restaurant Corp. in Garden City, Asian Moon Restaurant of Massapequa Park Inc., Golden Rod Restaurant Corp. in New Rochelle and their president will additionally pay $98,231 in civil penalties and interest for alleged violations of the federal Fair Labor Standard Act‘s minimum wage, overtime, and record keeping requirements.
Government investigators found that employees working as waiters and kitchen staff at the three restaurants were paid wages below the hourly minimum wage and also were not properly compensated for overtime hours – that is, those hours worked beyond 40 within a week.
According to the Department, the restaurants’ management maintained inaccurate and incomplete records of employees’ wages and hours worked.
The judgments require the restaurants and their president to pay back wages and interest to the Wage and Hour Division, which then will distribute the wages to the workers.
The restaurants are also required pay civil money penalties. The judgments additionally prohibit the restaurants from violating the FLSA in the future.
