Class action lawsuit accuses In-N-Out Burger of racial and age discrimination

In-N-Out Burger is a regional chain of fast food restaurants with 275 locations in the western United States.
A lawsuit alleging that the Irvine-based restaurant chain maintains hiring practices that discriminate on the basis of race, color and age.
The plaintiffs (two black men from Oakland over the age of 40) claim they were both qualified for the jobs they applied for at an East Bay In-N-Out location; however, they were not hired. According the plaintiff’s attorney, the suit alleges that In-N-Out Burger has “a pervasive policy of discrimination on the basis of race, color and age” in its hiring practices.
It explains that In-N-Out Burger “recruits, hires and maintains a work force that is predominantly under the age of 40 and/or non-African-American.” The suits asks the court to order the restaurant chain to end the discriminatory practices and to provide back pay and other monetary relief to those who have been unlawfully denied employment.
Arnie Wensinger, In-N-Out’s vice president and general counsel, denied the allegations in the lawsuit, stating that “the allegations in the lawsuit have no basis in fact,” Wensinger said. ” because “In-N-Out Burger does not discriminate on the basis of ethnicity, race or age in our hiring policies or practices. We hire from our local communities and our restaurants reflect the demographics of that community.” While we at the Harman Firm are note all surprised by the company’s wholesale denial, we fired that the company’s own records and statistics, will speak for themselves with respects to whether discrimination plays a role in hiring.
