Gender Discrimination Law
Title VII of the Civil Rights Act of 1964 is designed to protect employees from being discriminated against on the basis of ones gender, along with protections against discrimination based on race, religion, and national origin.
Title VII makes it illegal for an employer to instigate any illegal employment action motivated by an individual’s gender. This includes any matters relating to hiring, firing, job tasks and responsibilities, promotions and more. The amendment also prohibits perceived stereotyping of gender roles in making employment decisions, along with perceived notions of abilities based on gender.
Like other provisions of Title VII, the law makes it illegal to retaliate against any worker who opposes these illegal employment practices, be it by written complaint or filing charges against the emploer.
The Equal Pay Act of 1963 requires that individuals working in a particular location receive equal pay for equal work, regardless of their gender. The jobs do not necessarily have to be identical, but be similar in scope and scale. This act has worked to close the pay divide that had been created in the work force, where companies had paid women less money for the same jobs.
